NSW Rail Safety Act 1993 No 50 Part 2 Division 1 11(2) states:

"A person who operates a railway is guilty of an offence unless the person
is an accredited operator of that railway."

The definition of railway and operator in the act are very broad. If you
build 10ft of track in your back yard and run a fettlers trolley on it, you
are in breach of the act, and liable for a fine and/or imprisonment. Running
a trolley on ANY disused railway line, whether the line is legally open or
closed will land you in a heap of trouble if you are caught.
