It's in the access agreement between the track/spark operator
(Bayside/Hillside) and the train operator (VLP/FA/GNR etc).  If the train
breaks down, and causes a spark to run late, then the train operator pays
the track/spark operator money.   This money then compensates for the fine
the track/spark operater pays the DPT.

No, they lease the track, not trackage rights or access.  3rd party
operators then need an access agreement with the leasee.  Bayside or
Hillside, as the case may be.

Only if the train operator has an access agreement with the track operator.
If a track operator declines to provide access to a train operator, the
train operator currently can do little.  Once the relevant declarations have
been made, Bayside & Freight Australia will be compelled to provide 3rd
party access to freight only.  Not passenger traffic.

If I wanted to run a daily pass to Bendigo, or Freight to Coldstream, it
would be at the track operators pleasure, not the regulators insistence.

It's worth noting that most/all of the existing access agreements were
stitched up before the sale.
