First some questions:
Why would the franchise agreement for Hillside be fundamentally any different
to Bayside?
Does the franchise allow the operator complete control over the tracks ...or
only appropriate access to it.
Would not there be some anti-non competition provision that would compel
hillside to provide some access if only after mediation or
arbitration.???.Hillside dont own the tracks.

After all this..what is the fuss anyway..surely Hillside can slide in
one/maybe two movements a day..or are they that inept?? Bayside seem to do it
on their heads!!  One empty and one load of a steel (at least) a day.
If the logs were to operate during non peak periods...and in the oppposite
direction to the traffic of that time of day..whats the big deal!!
