Well, Rio argued in court the the line was part of the "mining process"and
therefore Robe River Mining Co. couldn't run their trains on Rio's track as it
would muck up Rio's very busy timetable, or so they say. Hence if they run a
train not associated the ore business other than general maintenance, like a
old steam loco towing a bunch of train nuts the plaintive(s) in the case could
say, if Rio allows a steam train why not us?

It will be interesting to see if Rio allows the PRHS to attach its passenger
rolling stock to a HI diesel and run trains in the future  (maybe Prof. Fels
will buy a ticket?) as up until now the line has been "off limits" for the
PRHS.
(since the time North Ltd, Robe River, and others started sending Rio nasty
solictors letters)
