Another aspect of this ruling that has escaped the notice of most here is 
"World's Best Practice" (WBP)  that is part of industrial relations landscape
in contemporary Australia.

If an Australian operator is required to adopt WBP in regard to running trains
it could be argued that US railroad operations indeed represent WBP as they are
one of the very few railroad operations that actually make money. A union could
then argue that WBP does indeed involve running trains with 2 persons.

Of course, if you'd prefer, feel free to reinsert your head into the sand!
