To Paul and Maury,
                  its as easy as this. The train always has priority.The
land the railway is constructed on belongs to that operater
eg the N.E line to Albury out of Melbourne is in the end owned by the
relevent track Authority Victrack, later the SG will be taken up by the
new National Authority.
                   Motor Vehicles may cross the Railway owned and
controlled land at their own risk! This may only be done at prescribed
crossing places which are maintained by the relevant Road Authority.
                   A Pedestrian or Motor Vehicle hit by a train would be 
IMHO basically Trespassing as they only have permission to use the
crossing if the Rail Authority is not using it at the time.
                    Now after spending a Torrid 5 hours in the Coroners
Court on Thursday......I can only wonder
