What I'm wondering is did he just assume that nothing was coming because this
isn't a regularly scheduled train on this line at that time. He claims there was
fog, but it doesn't look like it in the photos. Also, those headlights are
extremely bright and if you are looking out for a train, you can spot it from a
fair distance away. Although I can't be certain of this and I don't have all the
facts, it looks like it might be another driver not expecting the unexpected. If
it can be proven that he wasn't looking out for trains and was just driving
straight across, he should pay Freight Australia for the damages.
