What a load of trumped up crap. Sounds to me like they are trying to screw this guy, and are covering their arses well.

They produced 11 charges
they are as follows:

1.    You did fail to carry out a lawful direction by failing to sign
your name on the two way radio register as per written instruction

2.    you did fail to carry out a lawful direction by failing to attend

3.    you did fail to answer written corresponence dated 16&18 july,99
by 18/07/99,as instructed.  (code of workplace standards, under heading

4.    you did fail to wear cityrail uniform, provided to you, in full,
as instructed (code of workplace standards, under heading dress and
personal appearance,page13)  dates-18&19/07/99

5.    1. although rostered for duty from 0630hrs, you reported for work
approximately 60minutes late and failed to obtain approval for your

          2. you did fail to promptly advise of your inability to attend
work at 0630hrs as required. (code of workplace standards,under heading

6.    1.although rostered for duty from 1400hrs,you reported for work
approximately 5 minutes late and failed to obtain approval for your

7.    2.although you were rostered for duty between 1400hrs and 2200hrs
you did absent yourself from duty from approximately 1408hrs to
approximately 1425hrs,a period of about 17 minutes,without obtaining

8.    3.you did fail to carry out a lawful direction from duty manager
roberto perez to attend a meeting as instructed by the sector manager,
at approximately 1408hrs,stating words to the effect "he can wait

9.    you did fail to treat duty manager r.perez couteously in that you
did continue to state you would not attend a meeting with management
until you got coffee for yourself. (code of workplace standards, under

10.    you did fail to treat sector management courteously in that you
did say words to the effect "is this a squirrel's meeting?" (code of

SRA MANAGEMENT STYLE A CAUSE FOR CONCERN
On Wednesday 21st July Occupational First Aid Attendant, and RTBU Branch Councillor,
Paul Hayes was taken from his normal duties and placed to work in the Lost Property
Office in what is nothing more than a case of victimisation. At the time of writing this he
has not been charged with anything. 
Paul has worked tirelessly for all railworkers rights and has been particularly active in the
area of OH&S trying to improve safety and health aspects for us all. He has had a lot of
support on the job because many believe that what he has been doing is right. His actions
have got management and some others offside. They now have misused their powers to
force him out of his job which will also disadvantage him financially.
The danger is that he will be "fitted" with some trumped up charges and dismissed,
something that is quite probable. There are other avenues open to us such as the Industrial
Relations Commission and the Human Rights and Equal Opportunity Commission.
However the best form of defence is your support. We are asking for your support at this
crucial time because if management gets away with this nobody will be able to speak their
mind and we will all run around doing only what we are told.
We are all told that we live in a democracy, however these sort of acts by employers
prove that nothing could be further from the truth.
