I agree with everything you said. The right thing would be to charge both
runner and photographer on summons, a la Bob Hawke and the seat belt.

There is a similar thread in one of the American newsgroups about an
article in a radio ham magazine conducting a "fox hunt" (searching for
hidden transmitters). One was hidden in grass near a railway line, and one
compeditor described driving down the tracks to find it.
