One of the more bizzarre components to the whole saga of the creation of NR
and the abolition of AN is that when the legislation to create NR was first
drafted,it was pretty obvious that the Govt didnt think that it would have any
effect on ANs operation .
Indeed the legislation indicates that all we are doing is creating a new
railway body to handle interstate freight.
It seems to me fairly likely that the legislation writers had no idea what AN
actually did,or there would have been provisions in the Act for monies to be
set aside for possible adverse effects on ANs operation , and there
specifically arnt, indeed there are clauses which indicate that any adverse
effects on the railway operations of the shareholders,,ie NSW,VIC & the Feds
are NOT the fault NR.
If the Govt did understand what was going on , then at the same time that the
National Rail Corporation Agreement Act (was enacted) there would also be a
complimentary act to wind up AN , and there wasnt of course.
