Who does own S317? or who has it now...

On Friday I saw S317 looking a little faded [and at least externally, very
complete] outside Seymour Preservation.
Now I am told that a certain Victorian Private operator has cried foul to
the Allocation of this Loco to Seymour. My informer says that he has now
been given the right to
purchase this Loco.
I think that this is rather sad, if true, as 317 spent a large proportion of
its life on the Gauge in the North East, and Seymour would have at least
kept it home.
