Any railway lines in the state of NSW with a gauge of over 600mm (including 2
foot gauge) falls under the rail safety act. If someone at Manly for instance
purchased a 3'6" gauge trike and built 20 feet of railway line in their back
yard to move it backwards and forwards, it would fall under the rail safety act.
Exemptions can be obtained, but this takes time.

Any railway lines 600mm or less are classified as an amusement device and fall
under the appropriate act for amusement rides.
